Conditions of Carriage

IMPORTANT NOTICE
Please read all the following conditions carefully. By using our services, you agree to be bound by these conditions:

You confirm that:

You are using our services for business-related purposes; and

The recipient of the goods also operates a business in relation to those goods.

Our service pricing is based on the exclusions and limitations outlined in these conditions.

We are not liable for loss or damage to goods unless caused by proven negligence or misconduct (see clause 7).
-
Our liability is limited, even in cases of negligence. Contact us if you want to negotiate higher limits.
-
Arrange insurance to cover any goods being transported or stored. You must insure goods stored with us (see clause 13).
-
We do not carry certain "Excluded Goods" (defined in clause 1.1) and will not be liable for any loss or damage to them.


JAE88 TRADING
CONDITIONS OF CARRIAGE
1. DEFINITIONS AND INTERPRETATION
In these conditions:
-
"Carrier" means JAE88Trading Pty Ltd or any subcontractor used.
-
"Carriage" includes all related services such as transport, handling, packing, storage, and towing.
-
"Consignor" is the person or business engaging the Carrier.
-
"Goods" refers to any item accepted for transport.
-
Definitions for technical terms and references to applicable law are as described in the original full version.
2. NOT A COMMON CARRIER
We are not a common carrier and may refuse to transport any goods at our discretion.
3. CARRIER OBLIGATIONS
We:
-
Take reasonable care of goods and follow handling instructions.
-
Operate legally and with professional standards.
-
Aim for timely delivery but do not guarantee exact times.
-
Are not liable for conditions outside our control.
4. CONSIGNOR RESPONSIBILITIES
You must:
-
Notify us if goods require special handling or temperature control.
-
Ensure legal compliance (e.g., Chain of Responsibility Laws).
-
Confirm the goods are suitable for transport and are accurately described.
-
Indemnify us against losses from inaccurate or false information.
5. SHIPPING CONTAINERS
Give us two business days' notice before or after goods arrive/depart at a port. You must ensure containers meet timing and preparation requirements.
6. SUBCONTRACTING
We may use subcontractors. All our liability limitations extend to them.
7. LIABILITY LIMITS
We are not liable for:

Any loss/damage unless due to our proven negligence.
-
Consequential losses.
-
Excluded Goods or force majeure events.
-
More than $20,000 for Carriage or $2,000 for Storage per incident (unless otherwise agreed).
8. ROUTE DEVIATION
We may change the route or method of transport if needed.
9. INSPECTION
We may inspect goods if necessary. We are not liable for delays due to legal inspection requirements.
10. DELIVERY
If delivery fails and we cannot reach you, we may store or leave the goods. You will bear all associated costs
11. CRANE SERVICES
If we provide crane services, you must ensure the site is safe and accessible.
12. STORAGE
If we store goods:

You must give 48 hours' notice before removing them.
-
We are not obliged to release goods if payments are outstanding.
-
Additional handling costs may apply.
13. INSURANCE
You must insure stored goods and provide proof if requested.
14. DEFAULT
We may stop providing services if you breach the agreement.
15. LIEN
We hold a lien over your goods for unpaid charges and may sell goods after proper notice to recover costs.
16. CARRIER’S CHARGES
All charges are due per our agreed terms. You are responsible for additional costs (e.g., permits, delays, third-party payment defaults).
17. DANGEROUS GOODS
You must declare any dangerous goods and comply with laws. We may destroy hazardous items without compensation.
18. FORCE MAJEURE
We are not liable for delays caused by events beyond our control. Agreements may be terminated if delays exceed 30 days.
19. CLAIMS
You must notify us of any claim:
-
Within 2 hours for perishable goods.
-
Within 5 business days for other goods.
-
Within 14 days for stored goods.
20. LEGISLATION
Nothing in these terms limits your rights under the Competition and Consumer Act or any applicable law.
21. TRADING TERMS
Cancellations or changes to bookings made within 24 hours of the scheduled job may incur a full charge at the standard rate.
​New consignors may be required to pay 50% of the carriage charges in advance, prior to the commencement of the job.
All consignments must be paid in full within 7 days from the date of the carrier’s invoice.
If payment is not received in full by the invoice due date, the consignor may be liable to pay interest on the outstanding amount at a rate of 12% per month, accruing from the invoice expiry date until payment is made in full.
21. ENTIRE AGREEMENT
These conditions are the full agreement. Any changes must be in writing and signed by both parties.
22. GENERAL
Queensland law applies. Any unenforceable clause will be severed without affecting the rest of the agreement.
